1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Trinoxel ("Company," "we," "us," or "our") regarding your use of our fitness services, facilities, programmes, and website. By accessing our services, enrolling in our programmes, or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Terms apply to all users, members, and visitors of our services, regardless of how you access or use our offerings. If you do not agree to these Terms, you must not use our services or access our facilities. Your continued use of our services constitutes acceptance of any modifications to these Terms.
We reserve the right to modify these Terms at any time, with changes taking effect immediately upon posting to our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically to stay informed of any changes.
2. Service Description and Eligibility
Trinoxel provides specialised fitness and wellness services designed specifically for adults aged 55 and above. Our services include group exercise classes, personal training, fitness assessments, wellness workshops, nutritional guidance, and related health and fitness programmes.
To be eligible for our services, you must be at least 55 years of age and capable of participating in physical activity as determined by our health screening process. You must complete all required health questionnaires truthfully and undergo any necessary fitness assessments before participating in our programmes.
We reserve the right to require medical clearance from your healthcare provider before allowing participation in our programmes, particularly if you have pre-existing health conditions, take medications that may affect exercise capacity, or have concerns about your ability to exercise safely.
3. Membership Terms and Conditions
Membership with Trinoxel grants you access to specified services and facilities according to your chosen membership level. All memberships are personal and non-transferable. You may not share, sell, or transfer your membership privileges to any other person.
Membership Fees and Payment:
Membership fees are due monthly in advance and must be paid by the specified due date. Payment methods include direct debit, credit card, or other approved payment systems. Late payment may result in suspension of membership privileges and additional fees.
Membership Suspension and Termination:
Either party may terminate the membership agreement with thirty days' written notice. We reserve the right to suspend or terminate membership immediately for breach of these Terms, inappropriate behaviour, failure to pay fees, or violation of facility rules.
Refund Policy:
Membership fees are generally non-refundable. However, we may provide pro-rated refunds in exceptional circumstances such as permanent relocation, serious illness preventing participation, or other situations at our discretion.
Guest Policies:
Members may bring guests to specific events or classes with prior approval. Guests must complete health screening forms and may be required to pay additional fees. Members are responsible for their guests' behaviour and compliance with facility rules.
4. Health and Safety Obligations
Your health and safety are our primary concerns. By participating in our programmes, you acknowledge and accept certain responsibilities and risks associated with physical activity. You must disclose all relevant health information, including medical conditions, medications, and physical limitations that may affect your ability to exercise safely.
Medical Clearance:
You agree to obtain and maintain appropriate medical clearance for physical activity. If your health status changes significantly, you must inform us immediately and may be required to obtain updated medical clearance before continuing participation.
Following Instructions:
You must follow all instructions provided by our qualified staff, adhere to safety protocols, exercise within your prescribed limits, and immediately report any discomfort, unusual symptoms, or concerns during activities.
Emergency Procedures:
In the event of a medical emergency, we will provide immediate assistance and may contact emergency services and your designated emergency contacts. You consent to such emergency response actions and accept responsibility for any associated costs.
Equipment and Facility Use:
You must use all equipment and facilities properly and safely, report any hazards or damaged equipment immediately, and comply with all posted safety guidelines and facility rules.
5. Assumption of Risk and Limitation of Liability
You acknowledge that participation in physical exercise and fitness activities involves inherent risks, including but not limited to the risk of physical injury, medical emergencies, and exacerbation of existing health conditions. You voluntarily assume all such risks and agree that your participation is entirely at your own risk.
While we maintain comprehensive insurance and employ qualified professionals, we cannot guarantee that participation in our programmes will not result in injury or adverse health effects. You acknowledge that exercise involves physical exertion that may be strenuous and may cause or exacerbate physical conditions or injuries.
To the fullest extent permitted by law, Trinoxel, its employees, instructors, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your participation in our programmes, use of our facilities, or reliance on information provided by our staff.
This limitation of liability applies regardless of the legal theory upon which such damages might be based, including negligence, breach of contract, or any other cause of action. However, this limitation shall not apply to damages resulting from our gross negligence or willful misconduct.
6. Code of Conduct and Facility Rules
We strive to maintain a respectful, safe, and welcoming environment for all members. All users of our services and facilities are expected to behave appropriately and considerately toward other members, staff, and guests.
Respectful Behaviour:
All members must treat others with courtesy and respect, regardless of age, gender, race, religion, sexual orientation, disability, or fitness level. Harassment, discrimination, inappropriate language, or disruptive behaviour will not be tolerated.
Facility Cleanliness and Care:
Members must maintain cleanliness in all areas, wipe down equipment after use, dispose of rubbish properly, and report any cleanliness or maintenance concerns to staff immediately.
Class and Session Policies:
Members must arrive punctually for scheduled classes and sessions, cancel appointments with adequate notice when unable to attend, and follow instructor guidance and class etiquette to ensure everyone's safety and enjoyment.
Personal Property and Security:
Members are solely responsible for their personal belongings and valuables. We recommend not bringing unnecessary valuables and using provided security measures. Trinoxel is not responsible for lost, stolen, or damaged personal property.
7. Intellectual Property Rights
All content provided through our services, including exercise programmes, educational materials, assessments, and proprietary methodologies, are the intellectual property of Trinoxel House and are protected by copyright and other intellectual property laws.
Members are granted limited, non-exclusive, non-transferable rights to use our programmes and materials for personal fitness purposes only. You may not reproduce, distribute, modify, or commercialise any of our content without explicit written permission.
Our name, logo, and branding materials are trademarks of Trinoxel. You may not use our trademarks or branding in any manner without our prior written consent. Any feedback or suggestions you provide may be used by us without compensation or attribution.
8. Privacy and Data Protection
Your privacy and the protection of your personal information are important to us. Our collection, use, and protection of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to the collection and use of your personal information as described in our Privacy Policy. This includes health information necessary for safe programme delivery, contact information for communication purposes, and performance data for progress tracking.
You have the right to access, correct, or request deletion of your personal information in accordance with applicable data protection laws. However, certain information may be retained for legal or safety purposes as outlined in our Privacy Policy.
9. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
Before initiating formal legal proceedings, we encourage resolution of disputes through good faith negotiation. If you have a complaint or concern, please contact us directly so we can attempt to resolve the matter amicably.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
